POLÍN ET MOI X B TRAVEL

AVORIS RETAIL DIVISION S.L. with Tax Identification Number (NIF) B-07012107, with registered office at Calle Gremi Fusters No. 23, C.P. 07009 Palma, Balearic Islands, (hereinafter “B TRAVEL”) and POLÍN ET MOI, with Tax Identification Number (NIF) B-87225611, with registered office at Calle José Echegaray No. 8, Building 3, ground floor 3, 28232 Las Rozas (MADRID) (hereinafter “POLÍN ET MOI”) are organising a promotion called “POLÍN ET MOI X B TRAVEL” from Monday 5 May 2025 to Friday 9 May 2025, in order to promote their products and services. Therefore, B TRAVEL and POLÍN ET MOI will conduct a free random combination for advertising purposes (hereinafter the "draw") under the terms and conditions established in these rules.

RULES:

1.- DURATION, DATE OF THE DRAW, AND TERRITORIAL SCOPE.
Interested parties may participate, as explained below, from May 5, 2025, at 3:00 PM, until May 9, 2025, at 12:30 PM.
The winner will be selected on Friday, May 9, 2025, with management and collaboration between the marketing departments of B TRAVEL and POLÍN ET MOI, using the Easypromos tool. This tool allows the winner to be selected completely randomly and automatically. A Certificate of Validity is generated, ensuring the transparency of the draw, indicating the date and time of the draw.
The winner will be announced on Friday, May 9, 2025, at 12:30 p.m.
The sweepstakes are nationwide and free of charge, so participation does not entail the outlay of any additional funds.

2.- PARTICIPATION (REQUIREMENTS FOR ACCESS TO THE DRAWING).
Participants are only natural persons of legal age, residing in Spain, and users of the social network Instagram, with a profile registered in their name.
How to participate: To participate in the drawing, each user must complete the following steps:
Follow the B TRAVEL Instagram account (@bthetravelbrand).
Follow the POLÍN ET MOI Instagram account (@polinetmoi).
Like the collaborative reel that B TRAVEL and POLÍN ET MOI will publish.
Leave a comment on the B TRAVEL and POLÍN ET MOI collaborative reel, tagging/mentioning a friend they would travel with.
If selected as the winner, the winner must share five images from the trip featuring Santorini and each of the POLÍN ET MOI clothing sets, after signing the corresponding authorization for the transfer of image rights for the person(s) appearing in them, for promotional use by B TRAVEL and POLÍN ET MOI on their social media accounts.

Participation in the sweepstakes is cumulative, which means that each user may participate as many times as they wish, thus increasing the chances of winning the prize. However, cumulative participation will only be considered valid if each comment mentions a different Instagram friend's profile.

Participation in this sweepstakes implies full and unconditional acceptance of these rules. Participants can access the content of the rules governing this promotion through the website indicated below: btravel.com

The use of automated participation systems is prohibited, and in such cases, will result in exclusion from participation in the promotion. Registrations/participations made after the promotion's closing date, as well as those that do not meet the promotion's requirements or are not true, will be considered void.

3.- EXCLUSIONS FROM PARTICIPATION.
Those who do not meet any of the requirements established in these rules for access to the promotion may not participate. B TRAVEL and POLÍN ET MOI have the right to exclude those who do not meet the entry requirements from the draw.
Minors, Spaniards who are not residents of Spain, and foreigners who do not have a Spanish residence card are excluded from participating in the draw.
Employees of B TRAVEL and POLÍN ET MOI or any other company belonging to their respective business groups (as defined in Article 42 of the Commercial Code) are also ineligible to participate.
B TRAVEL and POLÍN ET MOI are not responsible for false, inaccurate, outdated, incomplete, or erroneous information provided by participants. In such a case, the participant will be automatically excluded from the drawing, losing the right to enjoy the prize (if they were a winner), and will have no right to make any claim against B TRAVEL and POLÍN ET MOI.
Furthermore, B TRAVEL and POLÍN ET MOI will remove from the promotion any participant who, in accordance with applicable legal provisions, infringes, through their participation, the intellectual, industrial, or other similar property rights of third parties or any regulations governing civil, criminal, or other laws.
Those who misuse the promotion, engage in fraudulent acts, or harm other participants will also be removed from the promotion. To this end, B TRAVEL and POLÍN ET MOI reserve the right to automatically remove and even withdraw the prize from any participant who has directly or indirectly benefited from such fraudulent acts, and may also pursue any applicable civil or criminal actions.

4.- WINNER SELECTION PROCEDURE.
The winner will be selected using the following procedure:
A list will be generated that includes registered participants from the start to the end of the promotion.
The winner will be selected on May 9, 2025, through the Easypromos platform.
One (1) winner and three (3) alternates will be randomly selected, numbered according to the order of selection.
The winner will be verified for correct participation in accordance with the procedures outlined in the rules.
If the winner does not meet the requirements, the first alternate will be selected according to the established list.
If none of the alternates on the list meet the requirements to receive the prize, the prize will be declared void.
The winner will be publicly announced on May 9, 2025, via an Instagram story by B TRAVEL and POLIN ET MOI.

5.- WINNER NOTIFICATION PROCEDURE.
B TRAVEL and POLÍN ET MOI will announce the winner through a story on B TRAVEL's and POLÍN ET MOI's Instagram accounts. The winner will have 10 calendar days to claim the prize by contacting B TRAVEL or POLÍN ET MOI via a private Instagram message on their respective accounts.
B TRAVEL and POLÍN ET MOI will request your information to effectively deliver the prize, as well as to require proof of legal age and legal residence. In order to successfully receive the prize, the winner must accept the prize, prove legal age and legal residence in Spain, as necessary conditions for access. B TRAVEL and POLÍN ET MOI reserve the right to withdraw the status of winner from users who do not meet both conditions required for participation, or who interpret the documentary evidence as potentially fraudulent. If the winning user does not contact the winner within the aforementioned 10-day period, B TRAVEL and POLÍN ET MOI will select the alternate from the list of alternates, following the same communication process, that is, by publicly announcing it on Instagram.
If none of the winners contact B TRAVEL and POLÍN ET MOI within the aforementioned period, B TRAVEL and POLÍN ET MOI reserve the right to declare the raffle void, with no right to claim or compensation.
B TRAVEL and POLÍN ET MOI are not responsible for computer failures and/or temporary service interruptions, the presence of viruses, or other elements that may affect the internet service.

6.- PRIZES. DESCRIPTION AND CONDITIONS OF USE. RESTRICTIONS.
The winner of the raffle will receive two prizes, one from B TRAVEL and the other from POLÍN ET MOI.
The B TRAVEL prize consists of a trip to Santorini for two people valued at ONE THOUSAND FIVE HUNDRED EUROS (€1,500), which includes:
Round-trip flights from Madrid to Santorini.
Three-night accommodations in a four-star hotel in Santorini, bed and breakfast included. The hotel will be selected by B TRAVEL in accordance with the established conditions and subject to reservation availability.
The prize includes only the services expressly identified, so any additional costs related to the prize will be borne by the winner and their companion.
The prize may be redeemed within one year from receipt, the date of the prize acceptance letter being deemed to be the date of the prize acceptance letter. Once the prize validity period has elapsed without being claimed, it will automatically expire without any right to claim. In any case, the period between July 20 and August 31, 2025, is excluded from the prize claim period and will be considered an embargo period.
The dates requested by the winner (within the claim period) will not entail any obligation on the part of B TRAVEL, and may be modified subject to availability. Once the reservation has been confirmed by B TRAVEL, changes or cancellations cannot be requested.
B TRAVEL is not responsible for any incidents, modifications, or cancellations by service providers. If applicable, the winner may be offered alternative options, without any right to claim against B TRAVEL.
B TRAVEL reserves the right to replace the prize with another of similar characteristics if, for reasons beyond its control, the planned prize cannot be awarded. The prize is personal and non-transferable to the winner, and therefore, it is essential that the winner enjoy it personally, accompanied by a companion of their choice.
The POLÍN ET MOI prize consists of four sets of clothing (one for each day of the trip) valued at approximately EIGHT HUNDRED AND FIFTY EUROS (€850), to be chosen by the winner from the selection indicated by POLÍN ET MOI, in accordance with the following conditions:
The sets of clothing will be complete, including shoes.
POLÍN ET MOI will send the prize to the address designated by the winner.
The winner will have fourteen calendar days from receipt of the prize to request any exchanges they deem appropriate. Notwithstanding the foregoing, POLÍN ET MOI will only cover the shipping costs for one of the exchanges; the winner must pay the remaining costs, if applicable.
Consequently, the total value of this promotional activity amounts to TWO THOUSAND THREE HUNDRED AND FIFTY EUROS (€2,350).
None of the prizes listed above are transferable or exchangeable for cash, or for any other product or service.
In order to receive the prizes under the conditions established in these rules, it is essential that, prior to their delivery, the winner expressly accept the prize to which they have been awarded, signing the prize acceptance letter that will be provided for this purpose and sending it to B TRAVEL AND POLÍN ET MOI within 48 hours of its dispatch. Failing this, B TRAVEL and POLÍN ET MOI may choose an alternate from the list of winners.

7.- TAXATION OF THE PRIZES.
All relevant tax provisions, in accordance with current Spanish legislation, will apply to the prize included in these rules.
In any case, the winner will be responsible for complying with any tax obligations that may arise due to the prize received, and therefore B TRAVEL and POLÍN ET MOI are released from any liability.
The winner must comply with the tax obligations inherent to the prize awarded. The prize will be subject to personal income tax withholding, under the terms and conditions established by the current tax regulations and at the legally applicable percentage for residents of Spain. B TRAVEL and POLÍN ET MOI, with respect to their respective prizes, will be responsible for the applicable withholding, paying it to the Tax Agency on behalf of the winner. Aside from this contribution, the winners' tax obligations will be borne by the winner, and B TRAVEL Y POLÍN ET MOI is therefore exempt from any further liability. To this end, and where required, B TRAVEL Y POLÍN ET MOI will issue and send a certificate with the details of the prize awarded and any applicable tax withholdings, in accordance with the provisions of the applicable tax and fiscal regulations in force at any given time.

8.- PERSONAL DATA PROTECTION.
In accordance with current legislation on personal data protection, the participant voluntarily provides their prior, unequivocal, and informed consent and, consequently, expressly authorizes the processing of their personal data (identification and contact information) in accordance with the following data protection policy, which contains the information on the processing of personal data provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") and in Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights.

i. To organize the raffle and award the prize to the winner.

Legal Basis:
The legal basis for processing your data is your consent, given by accepting the applicable legal bases or conditions and subsequent participation in the promotional activity.
If you additionally select the box(es) for the sending of commercial communications and/or authorize the transfer of your data to other companies in the Ávoris Group, we will send you communications about the products and services of B TRAVEL and/or companies belonging to the Ávoris Group, based on your consent.
Likewise, POLÍN ET MOI may send you commercial communications about its products to the extent that you provide your consent for this purpose by completing the box provided for this purpose.
Duration:
We will retain your personal data for the duration of the sweepstakes and after the corresponding acceptance and delivery of the Prize. After its conclusion, we will keep your data blocked for the duration of the limitation periods for any obligations that may arise from the processing and/or the applicable legal deadlines, remaining at the disposal of the competent authorities for the purpose of addressing any potential liabilities arising from the processing.
Recipients:
Personal data will be communicated to EASYPROMOS (EASYPROMOS, S.L.) for the purpose of conducting the sweepstakes and to third-party collaborators that provide services to B TRAVEL and POLÍN ET MOI, to the extent that such access is necessary to manage your participation in the sweepstakes. These third parties have been carefully selected, and both B TRAVEL and POLÍN ET MOI have signed the corresponding data processing contracts with them to ensure that your data is processed in accordance with the provisions of data protection regulations and this data protection clause. 9.- AUTHORIZATIONS.
Participation in the sweepstakes implies the winners' authorization for B TRAVEL and POLÍN ET MOI to use their first and last names for advertising purposes on B TRAVEL and POLÍN ET MOI's social media platforms for the purpose of announcing the winner of the sweepstakes. Failure to allow their names to be published will result in the winners' loss of the prize.

10.- CLAIMS.
The maximum period for filing any claim related to this sweepstakes will be ONE (1) month, counting from the date the winner is notified. B TRAVEL and POLÍN ET MOI are exempt from any liability for any damages that the winner may suffer due to the use of the prize.

11.- LIABILITY.
In accordance with the current promotional rules on Instagram, we inform you that this promotion is in no way sponsored, endorsed, administered, or associated with Instagram, or any other social media platform on which B TRAVEL and POLÍN ET MOI have a corporate account. By accepting the sweepstakes rules, participants are fully aware that they are providing their information to B TRAVEL and POLÍN ET MOI and not to Instagram (or any other social media platform). The information provided will only be used to manage the sweepstakes.

12. ACCEPTANCE OF THE SWEEPSTAKES RULES.
Participation in this sweepstakes implies full and unconditional acceptance of these rules. Participants also accept the discretion of B TRAVEL and POLÍN ET MOI to resolve any issues related to them. If any participant refuses to accept these rules or performs any act contrary to them, they will be automatically excluded from the draw, and B TRAVEL and POLÍN ET MOI will be released from any obligations incurred with said participant by reason of this draw.
In the event of force majeure or a justifiable cause, B TRAVEL and POLÍN ET MOI reserve the right to modify or even cancel these rules before the end of the publication period, and undertake to communicate any changes to them or their cancellation with sufficient notice.

13.- CONSERVATION.
If any of the conditions are found to be contrary to law, this circumstance will not affect the rest of the rules, which will remain fully valid for all relevant purposes. B TRAVEL and POLÍN ET MOI reserve the right to cancel or make changes to this draw, as well as to the prize offered, and undertake to announce said changes through any means they deem appropriate, as quickly as possible.

14. JURISDICTION.
The parties expressly agree to submit to the Courts and Tribunals of the city of Palma de Mallorca to resolve any dispute that may arise in the interpretation or execution of these terms and conditions. Therefore, they expressly waive any other jurisdiction that may apply, without prejudice to the mandatory provisions.
